1. Acceptance of Terms

By accessing or using Mocassai Social Hub, you agree to be bound by these Terms, our Privacy Policy, and all applicable laws and regulations. If you are using the Service on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.

Mocassai Social Hub is an AI-powered social media automation platform that provides:

• AI-generated social media content creation
• Multi-platform scheduling and posting
• Brand guideline management and storage
• Keyword research and content ideas
• Analytics and performance tracking
• Competitor analysis tools

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

3. Account Registration

Eligibility

You must be at least 18 years old to use our Service. By registering, you represent that you meet this age requirement.

Account Security

• You are responsible for maintaining the confidentiality of your account credentials
• You must notify us immediately of any unauthorized access to your account
• You are responsible for all activities that occur under your account
• You may not share your account with others
• You must provide accurate and complete information during registration

Pricing Plans

We offer three subscription tiers:

• Starter Plan: $97/month
• Professional Plan: $197/month
• Agency Plan: $497/month

Billing

• Subscriptions are billed monthly in advance
• Payments are processed securely through Stripe
• You authorize us to charge your payment method on file
• If payment fails, we will attempt to contact you and may suspend your account
• Prices may change with 30 days' notice

Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You are responsible for canceling your subscription if you do not wish to be charged.

5. Free Trial

New users receive a 14-day free trial. During the trial:

• You have full access to your selected plan features
• No payment is required during the trial period
• You can cancel anytime before the trial ends without being charged
• If you do not cancel, you will be automatically charged when the trial expires
• Free trial is limited to one per user/company

6. Cancellation and Refunds

Cancellation

You may cancel your subscription at any time through your account settings or by contacting support@mocassai.com. Cancellation takes effect at the end of your current billing period.

No Refund Policy

Exceptions

Refunds may be provided at our sole discretion in cases of:

• Billing errors or duplicate charges
• Service unavailability for extended periods
• Other extraordinary circumstances

7. User Responsibilities

You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information as needed
• Use the Service in compliance with all applicable laws
• Not use the Service for any unlawful or fraudulent purpose
• Not attempt to gain unauthorized access to our systems
• Not interfere with or disrupt the Service
• Not reverse engineer or attempt to extract source code
• Comply with the terms of service of third-party platforms (social media networks)

You may NOT use our Service to create, post, or distribute content that:

• Is illegal, harmful, threatening, abusive, or harassing
• Infringes on intellectual property rights of others
• Contains spam, viruses, or malicious code
• Promotes violence, hatred, or discrimination
• Contains sexually explicit or pornographic material
• Violates privacy rights of others
• Impersonates another person or entity
• Contains false or misleading information
• Violates the terms of service of social media platforms

Violation of this policy may result in immediate termination of your account without refund.

Our Rights

The Service, including its software, design, text, graphics, and other content (excluding user content), is owned by Mocassai and protected by copyright, trademark, and other intellectual property laws.

License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes, subject to these Terms.

10. Content Ownership

Your Content

You retain all ownership rights to the content you create, upload, or generate using our Service ("Your Content"). This includes text, images, brand guidelines, and social media posts.

License You Grant Us

By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to:

• Store, process, and display Your Content to provide the Service
• Use Your Content to improve our AI models and Service quality
• Create anonymous, aggregated analytics data

We will NOT share Your Content with third parties for their marketing purposes without your permission.

AI-Generated Content

Content generated by our AI tools is provided to you for your use. We make no guarantees about the accuracy, quality, or originality of AI-generated content. You are responsible for reviewing and editing all AI-generated content before publishing.

11. Service Availability

We strive to provide reliable service, but we do not guarantee that:

• The Service will be available 100% of the time
• The Service will be uninterrupted or error-free
• Defects will be corrected immediately
• The Service will be compatible with all devices or platforms

We may perform scheduled maintenance that temporarily interrupts the Service. We will attempt to provide advance notice of scheduled downtime when possible.

12. Disclaimer of Warranties

To the fullest extent permitted by law, we disclaim all warranties, including:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy, reliability, or completeness of content
• That the Service will meet your requirements
• That defects will be corrected

13. Limitation of Liability

This includes damages for:

• Loss of profits, revenue, or data
• Loss of business or business opportunities
• Reputation damage
• Service interruptions
• Errors in AI-generated content
• Third-party actions (e.g., social media platform bans)

Maximum Liability: Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months before the claim arose.

14. Indemnification

You agree to indemnify, defend, and hold harmless Mocassai and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your Content or any content you post using our Service
• Your violation of applicable laws or regulations

15. Termination

By You

You may terminate your account at any time by canceling your subscription through your account settings or contacting support@mocassai.com

By Us

We may suspend or terminate your account immediately, without prior notice, if:

• You violate these Terms
• Your payment fails and is not resolved within 7 days
• We suspect fraudulent, abusive, or illegal activity
• We discontinue the Service

Effect of Termination

Upon termination, your access to the Service will cease immediately. We will retain your data for 90 days, after which it will be permanently deleted. You may request a copy of your data before deletion.

16. Dispute Resolution

Informal Resolution

Before filing a claim, you agree to contact us at support@mocassai.com and attempt to resolve the dispute informally for at least 30 days.

Arbitration Agreement

If informal resolution fails, any dispute shall be resolved through binding arbitration in accordance with the American Arbitration Association (AAA) rules. The arbitration shall take place in Arizona, United States.

Class Action Waiver

Small Claims Court

Either party may bring an individual action in small claims court instead of arbitration.

17. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by:

• Posting the updated Terms on our website
• Updating the "Last updated" date
• Sending an email notification to your registered email address

Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms. If you do not agree with the changes, you must cancel your subscription.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, United States, without regard to its conflict of law provisions.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
